Reinstating Your License

About DMV APS Hearings

A DMV hearing is held following a DUI arrest. A DMV hearing is entirely separate from your criminal court case and will NOT address whether you are guilty of a criminal act, rather this is the chance for your attorney to explain the circumstances of your arrest and hopefully prevent the suspension of your driver’s license. We only have 10 days to request a hearing or the hearing is deemed a loss by default and your license will be suspended.

If you lose your DMV hearing, your license will be suspended and you will receive a notification in the mail regarding your pending license suspension. However, there’s a few options available to you to have your license reinstated:

Option 1 (Recommended)

1. Sign up for DUI classes

This option allows you to obtain a license without any restrictions on where or when you can drive. This option also allows you to get your license back with no waiting period. When the letter of suspension arrives from the DMV you can go to the DMV and have your license reinstated the same day the suspension begins if you have met all the requirements. To get this done you need to do the following:

Search for a DUI provider near you and call them to register for a DUI program. When registering, let the school know that it’s a volunteer registration and NOT court-ordered, otherwise you will be asked to provide documentation from the court, which you will not have. Please note that most first time DUI cases will require a 3-month program known as AB541. We recommend you confirm with Attorney Gallagher the type of program you should sign up for. 2. Add an SR-22 to your insurance policy

Call your existing insurance company and ask about adding an SR- 22 to your insurance policy. An SR-22 is typically required for a length of 3 years. Prices may vary, so we encourage you to shop around to get the best quote.

3. Install an IID breathalyzer in your vehicle

In order to reinstate your driving privileges, you will need to have an Ignition Interlock Device (IID) Breathalyzer installed in your vehicle. The average cost is around $100/month, so we encourage our clients to shop around for this as well. Click below for a list of state-approved IID vendors.

4. Go to the DMV and pay reissue fee

Go to the DMV on or after the date the suspension begins and pay the license reissue fee of $125

Option 2 (Restricted License + 30 day waiting period)

This option allows you to drive to and from work, to and from the DUI school, and during the course of employment (necessary driving required while working). This option also requires you to go 30 days without a license. So if you pick this option, you will have to wait 30 days before being able to apply. To obtain this license you need to do the following:
