What to do if You’re Pulled Over by the Police

Everyone dreads the sound of a police siren behind them and this unease often translates into nervous and perhaps suspicious behavior when the officer ultimately stops you and approaches your car. Many Orange County traffic ticket attorneys will suggest that by the time you are pulled over, the police officer already has a good idea what he or she will do with you. Although there may not be much you can do to make things better, there are things you can do to avoid a worse predicament.

 

Common Sense Approach

The first issue is pulling over in a safe and efficient manner. You may not be able to pull over immediately, but you can put your turn signal on and drive to the right side of the road. When you do stop, try to leave ample room for the officer to be able to approach the driver’s side window without being in danger from passing traffic.

 

Roll your window down, place your hands on the steering wheel and if it’s nighttime, turn on an interior light. Don’t make any sudden or unexpected movements. Wait until you are asked before you reach for you license, registration and insurance. If you speak, answer only what’s asked; don’t volunteer any information or make small talk. Law enforcement is trained to look beyond the stop, meaning that for any reason they pull you over, they are looking for signs of drinking, drug use or involvement, or anything else you may be hiding.

 

Be Realistic about Your Situation

You know if you have something to be worried about when you are being pulled over. Whether you have an outstanding warrant, may be under the influence or have an illicit substance in your vehicle, there’s very little chance you will walk away unscathed. Lying about your situation will only result in further complications for you, and talking can lead to possible admissions; your own words can and will be used against you.

 

Understand Your Rights

Most people know they have certain rights after they are in custody and under arrest, but you should be aware that you can refuse to speak with the police any time you wish and assert your right to counsel. The reality is that you may not avoid getting arrested, but by politely declining to speak with the police you may be able to mitigate your damages and limit your exposure.
